NON-CONTESTED DIVORCE OR SEPARATION
This is where the parties each agree to all of the issues related to their separation or divorce and do not require further negotiation. We can make a legal separation agreement that reflects what you have already agreed to, and proceed with a divorce by drafting all of the necessary documents and filing them with the court.
CONTESTED DIVORCE OR SEPARATION
This is where the parties do not agree on how to resolve the issues that come up in their separation or divorce. In situations like this the parties should each retain their own lawyer who can make court applications on their behalf or try the different dispute resolution processes such as negotiation, mediation or collaborative law.
MEDIATION
Mediation is a process of resolving disputes that uses a cooperative approach to conflict resolution. In this process the Mediator meets with the disputants to come to a mutually satisfactory settlement.
Mediation offers privacy over the court system as proceedings are kept confidential, while proceedings through the court are public record. And it can be a more economical and effective way of disputants to resolve their issues.
